When I applied to law school many years ago, I intended to be an Intellectual Properties attorney, a transactional attorney, a lover not a fighter. Imagine my surprise when I discovered that I enjoyed litigation more than transactional law, a warrior lawyer, fighting for what's right. My years as a prosecutor clarified my need for moral righteousness; few other areas of law satiate that need more than the new frontier of copyright and intellectual property.
Creators are entitled to the protections of law. The artist, writer, innovator, and the dreamers should get the benefits for their contributions. Efforts should be rewarded and their property rights should be protected from those who would take without permission, without compensation. These are the people that make life worth living while the rest of us struggle to make a living. They give us hope and affirm that there is no ceiling for achievement in this country if we are willing to dream and manifest our destinies.
On the other hand, bullies are squashing dreams and innovators. The Internet is the new West, wild, savage, and peopled by large land grubbers who distort the law to run others out of the territory. These predators aim to close the open ranges, fencing off great swaths of territory through provisional patents and comprehensive licensing agreements that aim to bind consumers rather than protect their creation. The matrix is born and the energy sucking machine herds Americans into pods of predetermined limitations. Forced programming on your computer is just one of the provisional patents looming against freedom and democracy. Capitalism spurring innovation and creativity through open and competitive markets is at risk on this new frontier. This new battle is being fought on the abstract electronic plains of America while most of us cannot even open our email. The beachheads are red with the blood of ambitious Americans gunned down for their initiative. Congress has very little understanding of the laws it passes, laws that are written by the special interest groups and submitted as templates for legislation, templates that undergo very little scrutiny by those that could understand the deeper issues that affect the fundamental fabric of the America that has been sanctified by the blood of heroes.
