Always Assume You Are Going to Trial.
Go into a courtroom ready to go to trial.
The best attorneys are trial attorneys. Trial attorneys are always willing to go to trial for their client. If a case settles with a good plea it is because an aggressive attorney was willing to go to trial. You should always be satisfied that you decided to settle or go to trial.
If you go to a doctor for an evaluation of a heart condition and you need an operation, you would be foolish to live vulnerable and stop at the evaluation; you need an operation. The DA's charges and offer are the heart condition; the cure may be trial. You want the best for this condition.
You Decide What You Want To Do.
You should be in the driver's seat. You should know all about the case and your options; you should choose what you want to do while your lawyer backs your decision and fights for you.
California District Attorneys cannot take every case to trial. Your best deals happen when the District Attorney knows that you will go all the way to trial.
Choosing the Right Attorney.
To choose the best attorney, look at their credentials first:
Number 1 -- Top Law School. This means they work harder and smarter than most anyone else. A Harvard Law School graduate is a rare find. Lawyers will tell you that is the most impressive credential.
Number 2 -- Experience. A former District Attorney knows how District Attorneys think and is not intimidated by them; he does not rollover on his client.
Number 3 -- Comfort. You should feel like you can talk to your attorney and that he listens, helping you to make smart decisions without substituting his judgment for yours.
Choose Carefully.
As in any profession, professionals at the end of the day are just people. There are some teachers that great teachers would never allow in the profession. Yet, our children are sitting in their classrooms today. There are doctors that other doctors believe have no business practicing medicine. Yet, we still sit in their waiting rooms hours after our scheduled appointment. There are people in professions that should not be, even though they meet the minimum criteria of the profession. Law is no different.
You get what you pay for. Do not pay for cheap attorneys, it can be a waste of money that you can apply to the fines you are going to pay when they plead you out and tell you that is the best you'll get.
Regretting Today's Decision.
Stuck with a court appointed attorney can lead to regrets. My clients experienced with court appointed attorneys regret that experience. Living with those decisions, they tell me they cannot afford not to hire me.
